The DoJ investigation, which began in November 2022 following the Eras Tour pre-sale issues, is examining:
- Live Nation's contractual terms with artists
- Potential restrictions on venues working with other promoters
- Artist payment structures and venue control
- Market competition concerns
According to a Wall Street Journal report, the DoJ has recently:
- Contacted promoters and venues about market competition
- Sent document retention letters to talent agencies
- Focused on Live Nation's 2020 artist-payout modifications
Live Nation's Q3 2023 performance showed record results:
- Total revenue: $8.15 billion
- Concert revenue: $6.97 billion (32% YoY increase)
- Ticketing revenue: $832.6 million (57% YoY increase)
Berchtold addressed key investigation points:
- DoJ is examining competitor complaints
- Investigation focuses on specific practices, not overall business model
- Document retention letters are standard procedure
- Investigation is in "mid-stages" with document production ongoing
- No depositions have started yet
The CFO suggested the timing of news reports coinciding with earnings releases "doesn't seem to be a coincidence," while maintaining that paying top dollar to artists and providing quality tour support are positive industry practices.
