Tool Fans Consider Legal Action Over Similar Concert Setlists at Dominican Republic Festival
Tool's first-ever 'Tool Live in the Sand' destination festival has sparked controversy, with fans considering a class action lawsuit due to similar setlists across two consecutive nights. The event, held at Hard Rock Hotel in Punta Cana, Dominican Republic, featured performances on March 7 and March 8.

The main point of contention is that four songs—"Fear Inoculum," "Rosetta Stoned," "Pneuma," and "Jambi"—were repeated across both nights, despite promises of unique performances. Given the premium pricing ($4,000 – $10,000), many attendees feel misled.
March 7 Setlist:
- Stinkfist
- Fear Inoculum
- Rosetta Stoned
- Pneuma
- Jambi
- Schism
- The Grudge
- The Flood
- Invincible
- Vicarious
March 8 Setlist:
- Fear Inoculum
- Ænema
- Rosetta Stoned
- Pneuma
- Jambi
- Descending
- Chocolate Chip Trip
- Intolerance
- Swamp Song

Law firm Stas Rusek is investigating a potential class action lawsuit against the festival organizers for alleged breach of contract and misrepresentation. Attorney Stas Rusek, both a Tool fan and festival attendee, is seeking to represent disappointed concertgoers.
Tool and frontman Maynard James Keenan have not addressed the controversy as they proceed with their first Latin American headlining tour, which includes stops in Mexico City, Guadalajara, Buenos Aires, Santiago, Bogotá, and São Paulo.
