The lawsuit targets Lil Durk, his former manager Andrew Bonsu, Only the Family group and label, and consulting firm TTPMG. The dispute centers on a song called "Bedtime" and involves a $600,000 agreement that would have given Exceed perpetual rights to the track's recorded royalties.
Key details of the case:
- Exceed paid $450,000 upfront by August 2022
- The agreement required Lil Durk to perform promotional activities
- In May 2023, Sony Music's Alamo Records revealed Lil Durk was under an exclusive recording agreement
- This meant neither the defendants nor Empire had rights to reassign revenue from "Bedtime"
- Exceed's attempts to recover the $450,000 payment were met with silence
The $12 million damages claim includes:
- The initial $450,000 payment
- A $600,000 contractual penalty
- Reputational damage
- SEC registration expenses
- Investor refund costs
Exceed Talent Capital, based in New York City with Israeli headquarters, has since withdrawn its current investment offerings and is reportedly developing new ventures.
