Brazil's Collective Defense Institute has filed lawsuits against Meta, TikTok, and Kwai, seeking $525.8 million in damages for failing to protect minors on their platforms. The lawsuit specifically targets the platforms' inadequate mechanisms to prevent unrestricted use by underage users and demands improved data protection measures.
The legal action requires these social media companies to:
- Modify their algorithms to better protect minors
- Implement stronger data protection for users under 18
- Improve supervision of teenage accounts
- Issue clear warnings about mental health risks
- Create safer user experiences aligned with developed nations' standards
This lawsuit follows similar legal challenges in other countries. New Mexico previously sued Meta and Snap Inc., revealing that Meta had documented over 100,000 cases of child harassment on their platforms. Additionally, 15 state attorneys general have sued TikTok for misrepresenting platform safety for young users.
In response, platforms have begun implementing protective measures:
- TikTok introduced controls for under-13 accounts
- Meta launched 'Teen Account' features on Instagram with automatic limitations
- Both companies face ongoing pressure to enhance minor protection measures
