The Supreme Court has agreed to hear TikTok's challenge against the impending U.S. ban, scheduling a crucial two-hour oral argument for January 10th.

The Court will focus specifically on whether the Protecting Americans from Foreign Adversary Controlled Applications Act violates the First Amendment when applied to TikTok and ByteDance.

Key Deadlines:

  • December 27th: Opening briefs due (13,000-word limit)
  • January 3rd: Reply briefs due (6,000-word limit)
  • January 10th: Oral arguments
  • January 19th: Ban takes effect (unless blocked)

The stakes are particularly high as the January 19th ban deadline approaches, just one day before the presidential transition. While President-elect Biden has expressed support for TikTok, he won't take office in time to prevent the initial ban implementation. The possibility of a 90-day extension remains unclear.

ByteDance maintains its position against selling TikTok, even as app stores prepare for the platform's potential removal. The ban's implementation presents complex logistical challenges beyond simply deactivating the service for its 150 million U.S. users.

The Supreme Court has deferred its decision on TikTok's requested injunction until after the oral arguments, making the January 10th hearing pivotal for the platform's future in the United States.
