Nirvana 'Nevermind' Album Cover Lawsuit Pushed to 2022 as Spencer Elden Prepares Amended Complaint
Nirvana faces a delayed lawsuit from Spencer Elden, the man who appeared as a baby on the iconic "Nevermind" album cover, with proceedings now pushed to early 2022.
The lawsuit alleges that Universal Music, Nirvana's surviving members, and others involved with the album cover "knowingly produced, possessed, and advertised commercial child pornography," causing Elden "permanent harm" and "lifelong loss of income earning capacity." He seeks all profits from the album, which has sold over 30 million copies worldwide.

Recent court documents reveal that Elden has yet to serve most defendants, though both parties have attempted mediation without reaching a settlement. Elden plans to file an amended complaint by November 22nd, with defendants required to respond by January 21st, 2022.
The case has drawn particular attention given that Elden previously embraced his connection to the album, having reshot the photo as an adult and tattooed "Nevermind" on his chest.

This development follows a separate dismissed copyright infringement lawsuit against Nirvana, which may be pursued in UK courts where the plaintiff resides.
