The disputed patent describes a method for selecting songs by comparing their moods against other songs using specific mood identification techniques. The technology is owned by Aperture Investments LLC, which holds approximately 15 patents related to music categorization using rhythm, texture, and pitch.

BMG Synch, the service in question, is a digital platform that enables clients to license music for synchronization purposes. The platform allows users to search and listen to tracks from various artists, songwriters, and composers across different genres.

In a separate but related case, Muvox has also filed suit against IBM for their AI-powered music platform that analyzes and reproduces music based on mood identification.

This lawsuit follows similar patent infringement cases filed against Warner Music Group and Universal Music Group in 2023 by Blue Spike LLC, which focused on digital content encoding and distribution patents.
